Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of The Whale Tea mobile application and website (the “Services”), operated by The Golden Whale International Pte. Ltd. (“we”, “us”, “our”). By creating an account or using the Services, you agree to be bound by these Terms.

1. Eligibility and account registration

You may create an account using email and password, or by signing in via Google, Apple, or WhatsApp. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep it up to date.

2. Reward points programme

  • Earning points: You earn reward points through qualifying purchases, referrals, participation in in-app games, and other activities we designate from time to time.

  • Redeeming points: Reward points may be redeemed for vouchers, which can be applied to qualifying orders to receive a discount, subject to the terms displayed at the time of redemption.

  • Expiry: Reward points and vouchers may expire after a period stated in the app. Expired points and vouchers cannot be reinstated.

  • No cash value: Reward points and vouchers have no cash value, cannot be transferred for monetary consideration, sold, or exchanged outside the app, and cannot be redeemed for cash.

  • Forfeiture: We reserve the right to suspend, deduct, or forfeit reward points and vouchers obtained through fraud, abuse, or violation of these Terms.

3. Referral programme

  • How it works: Existing users may share a unique referral code with others. When a new user signs up and meets the qualifying conditions stated in the app (such as completing a first purchase), both the referrer and the referred user may receive reward points or vouchers.
  • Fair use: Referral codes are intended for genuine personal recommendations. Creating multiple accounts, using fake identities, or otherwise manipulating the referral system is prohibited and may result in forfeiture of rewards and/or suspension of your account.
  • Changes: We may modify or discontinue the referral programme, or the rewards associated with it, at any time.

4. In-app games

From time to time, we may offer in-app games that allow you to win reward points or vouchers. Participation is voluntary and subject to any additional rules displayed within the game. We reserve the right to determine winners, void results obtained through cheating, exploits, or automated means, and to modify, suspend, or discontinue any game at our discretion. Game rewards are subject to the same expiry and forfeiture provisions as other reward points and vouchers.

5. Orders and payment

Orders placed through the app are subject to product availability and store operating hours. Prices are as displayed at the time of order and may include applicable taxes. Payments are processed through our third-party payment processor; by making a purchase, you agree to that processor’s applicable terms. Vouchers and reward point redemptions are subject to any minimum spend or exclusions stated at checkout.

6. Location services

The app may request access to your device’s location to help you locate nearby stores and receive relevant offers. You may disable this at any time in your device settings, though some features may not function as intended without it.

7. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose.

  • Attempt to gain unauthorised access to the Services, other users’ accounts, or our systems.

  • Use bots, scripts, or automated means to interact with the app, including to farm reward points or manipulate games.

  • Create multiple accounts to abuse promotions, referrals, or game rewards.

  • Reverse engineer, decompile, or attempt to extract source code from the app.

8. Account suspension and termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the rewards, referral, or game systems. Upon termination, all associated reward points, vouchers, and referral credits will be forfeited.

9. Account deletion

You may request deletion of your account at any time. To submit a deletion request:

  • Via the app: Navigate to Settings → Account → Delete Account.
  • Via the website: Use the “Account Deletion” option at https://thewhaletea.com.sg/contact/.
  • Via email: Contact us at tech@thewhaletea.com.sg.

We will verify your identity before processing the request. Please note that once your account is deleted, all reward points, vouchers, order history, and referral credits associated with your account will be permanently lost and cannot be recovered. Processing may take up to 30 days.

10. Intellectual property

All content, branding, logos, and materials within the Services are owned by or licensed to The Golden Whale International Pte. Ltd. and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Services without our prior written consent.

11. Disclaimers and limitation of liability 

The Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, or free of defects. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services, including loss of reward points, vouchers, or game results due to technical issues.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the app or by posting an updated version on our website with a revised “Last updated” date. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Singapore, and any disputes arising from them shall be subject to the exclusive jurisdiction of the courts of Singapore.
